The Utah-based SCO Group has been cleared to appeal a court ruling that might lead to a revival of its dispute with IBM over copyright claims to the freely distributed Linux operating system. Utah Federal Judge Dale A. Kimball has signed a final judgment in a case involving Novell, in which he had awarded Novell $2.5 million for some of the revenues SCO obtained in licensing the Unix computer operating system.
On Aug. 13, 2008, the Court of Appeals for the Federal Circuit issued a decision in the much-watched case Jacobsen v. Katzer, No. 2008-1001, which turned on whether violating an open source licensing agreement should be considered copyright infringement. It is important for companies to be aware of the implications of this decision.
Not long after Joichi Ito uploaded a photo he had taken of Internet pioneer Vinton Cerf to the online encyclopedia Wikipedia last year, he noticed something odd. Most of the Internet luminaries and technology gurus who had write-ups on Wikipedia had poor-quality photos or none at all. Open source developers now have newly clarified protection, thanks to an appeals court ruling over the validity of their licenses. A judge with U.S. Court of Appeals for the Federal Circuit ruled Wednesday that programmers who “engage in open source licensing” and copyright their work do “have the right to control the modification and distribution” of their products.
In a somewhat surprising move from a company that rattled sabers with what seemed like the entire open source software world last year, Microsoft has become a sponsor of the open source Apache Software Foundation and has opened up some of its protocols for use by OSS developers. Microsoft’s Sam Ramji, director of the company’s Open Source Software Lab, made the announcement at OSCON.
